Bute Park Improvement Project Donation Scheme

Please read these terms and conditions carefully before using the site or donating cash to the improvement project.

Definitions

Bute Park Improvement Project Donation Scheme: All activities (including but not limited to project design, planning, procurement, transaction processing, card processing charges, website updates and marketing) related to the administration of a scheme that allows people the opportunity to voluntarily give cash gifts towards a specific, named Improvement Project within Bute Park.

Donation: A cash gift made to Cardiff Council for the purpose of going towards an Improvement Project.

Donor: the individual making a Donation to an Improvement Project.

Improvement Project: The current named project as displayed on the Website at the time of viewing. Only one Improvement Project will run within Bute Park at any one time. Past project pages will be closed but archived on the bute-park.com website for reference.

VAT: Value Added Tax

Who we are and how to contact us

www.bute-park.com is a site designed and operated by the Bute Park Group. We are a body run by Cardiff Council as part of its Economic Development Directorate and have our registered address at County Hall, Atlantic Wharf, Cardiff, CF10 4UW. General

If any provisions of these terms and conditions are held to be invalid or unenforceable, this will not affect the validity or enforceability of the remaining provisions.

These terms and conditions constitute the entire agreement between you and Cardiff Council and supersede all other communications and proposals, whether electronic or written, between the user of the Website and Cardiff Council.

Any failure of Cardiff Council to exercise or enforce any of its rights under these terms and conditions shall not be deemed to be a waiver of any such rights.

 

Jurisdiction

The terms and conditions and the use by the user of the Website are governed by the laws of England and Wales. Any disputes arising from or relating to the Website, any transactions made on the Website and/or these terms and conditions will be subject to the exclusive jurisdiction of the courts of England and Wales.

By donating to an Improvement Project you accept these terms

By using the Website to donate cash gifts to any named Improvement Project, you confirm that you accept these terms of use and that you agree to comply with them.

If you do not agree to these terms, you must not use the Website to make Donations. You cannot make Donations unless you agree with these terms by ticking the box to indicate that you have read and understand these terms. We recommend that you print a copy of these terms for future reference.

We may make changes to these terms

We amend these terms from time to time. Every time you wish to use the Website to make donations, please check these terms to ensure you understand the terms that apply at that time.

We may make changes to the Website

We may update and change the Website from time to time to reflect changes to our Improvement Projects.

Reliance on information on the Website  

The content on the Website is provided for general information only. It is not intended to amount to advice on which you should rely.  

Although we make reasonable efforts to update the information on the Website, we make no representations, warranties or guarantees that the content on the Website is accurate, complete or up to date.

 

Making a Donation

By making a Donation, you agree to make a gift of cash to Cardiff Council for the purpose(s) stated on the Website under the Improvement Project which is being donated to.

There is a minimum Donation amount of £2.00 (two pounds). No Donation may be made which is less than £2.00. There is no maximum limit on Donation amounts but if you wish to make a donation larger than the remaining balance on the current Improvement Project, please contact butepark@cardiff.gov.uk to discuss your options. Any amounts made that exceed the current Improvement Project will be retained and rolled over to the following Improvement Project.

Donations may only be made by those who are the account holder(s) of the account from which the Donation is made, or by someone who has the permission of the account holder(s) of the account from which the Donation is to be made to make a Donation.

 

Taxation

Donations to named improvement projects are not subject to Value Added Tax (VAT).

 

Gift Aid

Cardiff Council is not a registered charity in England and Wales. Therefore, any Donations will not have the benefit of Gift Aid.

 

Retention of funds

Cardiff Council will retain up to 25% of all Donations, which will go towards the administrative costs and budget of running the Bute Park Improvement Project Donation Scheme. For further information on the specific amount to be retained for administrative costs, please visit the Website.

All personal data held by us or on our behalf is held in accordance with:

 

Refunds

If you make a Donation, you are entitled to a full refund of the monies you have Donated within 14 days of the date on which your Donation was made. Should you require a refund, please send an email to butepark@cardiff.gov.uk or call 02920 872730 in office hours Mon – Fri 9am – 5pm and provide the Donation reference number, which will be included on your electronic receipt.

 

Refusal of Donations

We reserve the right to refuse Donations made to an Improvement Project which are:

  • Made from an account belonging to a business. Only private individuals may Donate
  • Unlawful (e.g. Donations made using proceeds of crime) or not in accordance with the policies of Cardiff Council
  • Made by someone who, at the time of Donation, lacked mental capacity to make such a Donation
  • Not in accordance with the aims and purposes of the Improvement Project, which can be found on the Website

 

Limitation of liability

We will not be liable for any direct, indirect or consequential damages (even if foreseeable) whether based on contract, tort or otherwise, to the fullest extent permitted by law. This includes but is not limited to liability for: loss of data or profits; interruptions or delays to the Website; the provision of or failure to provide services; any information, material, goods and services obtained through the Website; or otherwise arising out of your use of the Website.

 

Force majeure

Cardiff Council will not be in breach of its obligations under these terms and conditions, nor liable to any user of the Website for any loss or damage which may be suffered by another party due to any cause beyond its reasonable control. This includes but is not limited to any act of God, strike, trade dispute, act of terrorism, act or omission of government or regulatory bodies.
